Makebook - Terms of Use

The full Terms and Conditions Statement should be read for any required clarification.

Makebook is a great place for you to create any kind of book, story or other publication that can be described using words, pictures and rich media.

Makebook enables you to Author your work, Share it with friends for comments and collaboration and then Publish your finished product to the Makebook Electronic Library; to a hard copy book that is printed on demand or to an electronic format you can share right across your social network.

As you can imagine, having gone to all of this trouble to create such a great application, we have some rules. We believe that if everyone understands and abides by our Makebook Terms of Use, our Makebook Members will enjoy our Site and have a great time.

These are the Terms of Use you need to understand before you join Makebook and write that story, recipe, book, whitepaper, or any other type of publication.

The Makebook application and service ("Makebook" or "the Service") are fully owned by an Australian Company called Makebook Pty Limited (the "Company").

We call all of the conditions of using Makebook our "Terms of Use" or "Agreement" that all of our Members and visitors must agree to before using the Makebook web site.

Our web site, we call it the "Site" is found at http://www.makebook.com. When you access our Site or create a Link to our Site from anywhere else, you are agreeing to having read our Terms of Use and agree to be bound by these Terms of Use whether you are a registered Makebook Member or just a Visitor to the Site.

To use the functionality of Makebook, we ask people to register on the Site as a Makebook Member. When you do this, these Terms of Use will be shown. When you confirm that you want to be a Makebook Member, having read the Terms of Use, you will be allocated a Makebook Member Login. Not only will you be set to go in Makebook, the Terms of Use will bind you and Makebook Pty Limited.

When we change the Terms of Use, we will let you know that we have done so and take you to a summary screen that shows the changes. We have so many Members that we don't make you re-read the Terms of Use. We need you to understand that we only ever have one Terms of Use document that represents the current agreement between you and Makebook and you must keep yourself up to date with any changes.

If you don't like the changes, you will have to stop using Makebook and cancel your Makebook Member account.
If you keep using the Site after changes to the Terms of Use, Makebook takes that as your acceptance of the new Terms of Use.

Who can be a Makebook Member?

We try really hard to ensure that everyone who registers for a Makebook Member account has fun and is protected from damaging and offensive content and bad Internet influences. We can only do our best and do not guarantee that we will catch everything. For your information, the Makebook creators all have kids below 18 years old so we get it.

To achieve this level of protection, we really need to know the Age of the Member joining. Any person under the age of 18 can be a Makebook Member, we just need to make sure that if the Member is under 18, the child's Parent or Legal Guardian has reviewed the Site, the Terms of Use and authorise the child to join Makebook.

Registration Data : Account Security

In consideration for using our Site, you have to agree to:
  • Ensuring all of your Member account details are correct on our Membership Registration form. You must keep these details up to date so we can make sure you get information you need to know.
  • Maintain the security of your password and on line Pen Name.
  • Be responsible for the use of your Member account and anything that happens in your name, from using your Member account.

  • Proprietary Rights in Site Content : Limited License.

    Anything that is on the Makebook Site, is ours. This includes the designs, the text, graphics, pictures, video, applications and anything else that you can see other than content that belongs to Members.

    As such, hands off it. You cannot copy, change, re-purpose, distribute, scrape or do anything we have not mentioned here on our Site, unless we say you can in writing, five copies all signed in triplicate.

    When you are a Makebook member, we grant you a limited license to access and use the Site and if you like, print a copy of the Site for your own, non-commercial use. We do NOT allow you to infringe in any way on our Copyright and Trademarks and if you do, we will at least cancel your Makebook Member account.

    Basically, if you want to be original like us, go and be original yourself. Leave our Makebook site, ideas, images, graphics and applications alone.

    Makebook and its logos, designs and graphics are registered trademarks of the Company. No one is permitted to use them without our permission, you guessed it - five copies all signed in triplicate.

    Member Conduct.

    To maintain a happy and creative space, we need a standard of behavior from our Members. There are also legal requirements that you have to understand and agree to.

  • These are as follows:
  • You must only ever post words and or other materials such as images and graphics to Makebook if you are their creator. This material must not be offensive, libelous. Defamatory, unlawful, religiously or racially intolerant or offensive or pornographic in any way.

  • You cannot share, post or transmit any material to the Site that infringes on Copyright or Trademarks that belong to others.

  • You cannot harvest emails or use automated scripts that collect information, intercept data or overburden the Site with any automated routines.

  • Upload or write anything that does not belong to you or was created by you other than by following the accepted practices of acknowledging other people's copyright, trademarks and ownership.

  • Upload any personal information about any person without their consent. This includes telephone numbers, email addresses, home addresses or banking information.

  • Do anything that is unlawful in the country that you live in. Makebook must never be used in any capacity that breaks any law.

  • Harass any other Makebook Member so as to deny their enjoyment of the Site or expose Makebook to any harm or liability of any type.


  • If we find out that any Member is breaking the expected member Conduct we will cancel your Member account and at all times assist authorities with any criminal investigation.

    Member Content posted on the Site

    Makebook allows any Member to post text, images, graphics, videos, information and messages (examples of "Member Content") onto the Site for their use.

    At all times, Members must understand that they are solely responsible for the Member Content that is posted to the Site. You may not post, transmit or share and member Content on the Site that you did not create or have permission to post.

    If you break these rules, we will delete offending the Member Content immediately.

    You are solely responsible at their cost and expense, for creating backup copies of all content and materials that are posted to the Site. When you post your Member Content to the Site, you are automatically authorising us to make backup copies, as we consider necessary to maintain the data integrity of the Site.

    When you post Member Content to the Site, you are granting the Company automatically (as well as representing and warranting that you have the right to), a world wide perpetual, non-exclusive, transferable fully paid world wide license to use, copy, publicly display, reformat, translate and use in conjunction with Site advertising and promotion.

    When you remove your Member Content from the Site, the above granted license will expire. You acknowledge and authorise Makebook to hold archived copies of your Member Content. Makebook will not assert any ownership over your Member Content. Makebook reserves the right to show and use your Member Content.

    Use of Share Links by Other Online Content Providers.

    Third Party Sites (anyone other than Makebook) may publish a link to the Site. When a member of the public follows this link, they agree to abide by and be subject to the applicable sections of our Terms of Use.

    Member Disputes

    If you have a dispute, you should lodge a Dispute on the Site under the section Dispute Resolution. There is a form that needs to be completed. If you state the facts as you see them, we will see what we can do to solve any dispute you might have with us or another Makebook member. We will act immediately if there has been a breach of our Terms of Use or there is a situation where Children are at risk of exposure to offensive and disparaging material. Anyone that brings to our attention any materials that are not suitable for children under the age of 18, will be awarded with a free annual membership.

    Disclaimers and Limited Liability

    Makebook has set out to make a Site that is safe and fun to use. We do our best to maintain a regular and reliable service delivery to all Members but if something happens to the delivery of the Site and Service, we are not responsible in any way and you acknowledge that you will never hold us responsible. You acknowledge that the maximum liability to you for any cause whatsoever is limited in all cases to $100.

    Indemnity

    At all times, you agree to never hold the Makebook Directors, Employees and Agents to be liable to you for anything in any way.

    Termination

    We can delete your Member Account at any time for any reason. When we are notified of a Member's death we will assign access to the legal executor of the Member's estate for a maximum period of 3 months. After that we will delete the deceased Member's Account.

    Other

    We don't have and never will have any other agreements with members other that this Terms of Use agreement. These Terms of Use apply at all times, aligned to the current version displayed on the Site at all times.

    Makebook Privacy Policy
    Makebook is committed to protecting the privacy of the personally-identifiable information that we collect from you as you use this Web site (the "Site"). The scope of Makebook's commitment is detailed in this Privacy Policy. By submitting information, you agree to Makebook's use of such information as described herein. Please see our Terms of Use for more information about our on-line policies in general.

    What personally-identifiable information is collected?
    Makebook collects personally-identifiable information on certain areas of the Site when users register, and participate in user posting areas, such as discussion forums and ratings. The personally-identifiable information collected may consist of information that you provide, such as names and e-mail addresses and other personally-identifiable information you supply. In addition, Makebook collects certain information that you do not visibly enter, such as your IP address, browsing pattern on the Site, click stream, and the status of cookies placed on your computer by Makebook, as described below.

    How may Makebook use my personally-identifiable information? Makebook uses your personally-identifiable information to fulfill your requests for information, Makebook also uses personally-identifiable information to perform statistical analyses of user behavior in order to measure interest in specific areas and information posted on our Site.

    Are cookies and IP addresses used?
    The Site uses cookies to identify you and your interests and to track usage of the Site. Cookies are small pieces of text stored on your computer that help us know which browser you are using and where you have been on the Site and on Web sites to which you may link in order to use some of our features. By accepting our cookie, you will be permitted access to certain pages of the Site without having to log in each time you visit.     Is personally-identifiable information disclosed to third parties?
    Makebook shall not intentionally disclose or transfer (and shall take reasonable steps to protect the confidentiality and security, and to prevent the unauthorized or accidental disclosure of) your personally-identifiable information to third parties (i.e., persons or entities that are not affiliates of Makebook), whether for such third parties' marketing purposes or otherwise, subject only to the following four exceptions: Makebook may disclose your personally-identifiable information to third parties in the event that such disclosure is required by the laws, rules, or regulations of any nation, state, or other applicable jurisdiction; Makebook may disclose your contact information to third parties as appropriate for Makebook to make transmissions or deliveries to you; Makebook may disclose your personally-identifiable information if, in connection with submitting the information, you consent to such disclosure; and Makebook may disclose contact information for you in response to inquiries by bona-fide rights owners in connection with allegations of infringement of copyright or other proprietary rights arising from information you have posted on the Site or otherwise provided to Makebook.

    Links to third-party sites

    We may provide links to third-party Web sites as a service to our users. In addition, some of the content appearing to be on this Site is in fact supplied by third parties, for example, in instances of framing of third- party Web sites or incorporation through framesets of content supplied by third-party servers. Please be aware that we cannot control and are not responsible for the information collection practices of such third-party Web sites, which may differ from those of this Site. We encourage you to review and understand the privacy policies on these Web sites before providing any information to them.

    How can I access, change, and/or delete information?

    You may access, correct, update, and/or delete any personally-identifiable information that you submit to the Site.

    Security

    Makebook has implemented generally accepted standards of technology and operational security in order to protect personally-identifiable information from loss, misuse, alteration, or destruction. Only authorized Makebook personnel are provided access to personally-identifiable information, and these employees are required to treat this information as confidential. Despite these precautions, McKinsey cannot guarantee that unauthorized persons will not obtain access to your personally-identifiable information.

    Transborder hosting and transfer of information

    Personally-identifiable information collected on the Site may be transferred from time to time to Makebook offices or personnel, or to third parties, located throughout the world, including offices located outside the European Economic Area (EEA), and the Site may be viewed and hosted anywhere in the world, including countries (such as the United States) that may not have laws of general applicability regulating the use and transfer of such data. By using the Site and submitting such information on it, you voluntarily consent to such transborder transfer and hosting of such information.

    Children's on-line privacy protection

    Makebook understands the importance of protecting children's privacy, especially in an on-line environment. Makebook will do everything it can to protect the privacy of minors.

    Consent; Changes to Privacy Policy

    By using the Site, you consent to the collection, use, and storage of your information by us in the manner described in this Privacy Policy and elsewhere on the Site. We reserve the right to make changes to this Privacy Policy from time to time. We will alert you to any such changes by updating this Privacy Policy.
